Product Testing Program Terms

3. Tester Requirements

Each selected Tester agrees to complete the following five components of participation in full. These deliverables ensure a thorough and beneficial exchange that supports product development, transparency, and brand trust.

A. Qualitative Feedback
Testers must submit a written feedback report that thoroughly documents their experience using the BAM Pilates Board. This includes but is not limited to: setup process, ease of use, perceived quality, stability, design functionality, comfort, and the effectiveness of the product in supporting their Pilates or wellness goals (e.g., strength, flexibility, posture, or mobility). Feedback should be honest, thoughtful, and rooted in actual use of the product in a home environment. We understand and respect that some individuals may wish to participate in our product testing program without having their personal feedback publicly shared. In such cases, participants have the option to provide a private Star Rating only, rather than submitting a written review or qualitative comments. This rating will remain confidential and is shared solely with our internal teams and authorized retail partners, such as Amazon.com, Walmart.com, or other participating marketplaces, for the purpose of improving product quality and customer experience. No personal identifiers will be published or disclosed in connection with these private ratings.

B. Photo Submission
A minimum of three (3) original, high-quality photos must be submitted as part of the deliverables. These images should clearly depict the BAM Pilates Board in use or staged in the user’s home setting. While selfies or user-inclusive photos are encouraged, they are not required. Photos must be taken by the Tester and not sourced from third parties. These images may be used for promotional purposes by BAM Athletica.

C. Optional Video Submission
While not mandatory, Testers are encouraged to submit a short video (30 to 90 seconds) that captures either a demonstration of the product in use or a brief verbal review. Videos help educate future customers and may be featured on BAM’s website, onlien marketplaces as Amazon.com or Walmart.com or social media. All video content must be original, relevant to the product, and submitted in a commonly used file format (e.g., MP4, MOV).

D. Public Product Page Review
Following the testing period, Testers are required to post an honest review on the official BAM Athletica Pilates Board product page (a direct link will be provided) and positive rating (ex. a star rating). The review should reflect the Tester’s experience with the product, including any pros or suggestions. Reviews must be authentic and written by the Tester only. BAM reserves the right to request the publisher such as Amazon.com to remove any reviews found to be plagiarized, offensive, or misleading.  Participants who prefer to keep their feedback private may choose to submit a star rating without written commentary. This option is available for those who do not wish to have their qualitative input shared publicly. The submitted rating will be treated as confidential and used exclusively by BAM Athletica and select retail partners, including platforms such as Amazon.com and Walmart.com, to help enhance product development and customer satisfaction. No identifying information will be published or linked to these private ratings.

E. BAM Store Review and Rating
To complete the program, Testers must also leave a positive star rating and optional review reflecting their experience with BAM Athletica’s customer support and the business. This includes aspects such as the ordering process, shipping speed, packaging quality, and customer communication. This feedback supports customer service optimization and helps future shoppers make informed decisions.

F. Media Submission Rights & Licensing Waiver
As a condition of participation in the BAM Athletica Pilates Board Product Testing Program, you agree that all content you create and submit—including written feedback, product reviews, store reviews, photos, and videos—will become the sole property of BAM Enterprises (parent company of BAM Athletica) upon submission.

By submitting any media or written materials to BAM, you irrevocably grant BAM Enterprises a royalty-free, perpetual, worldwide, and unrestricted license to use, copy, edit, reproduce, publish, distribute, and display the content across all platforms and media formats—both digital and physical—without limitation. This includes, but is not limited to, usage in marketing campaigns, product pages, social media, advertising, packaging, promotional materials, editorial content, investor communications, and educational content.

You waive any and all legal rights to the submitted content, including the right to attribution, compensation, future licensing claims, or the ability to withdraw permission for its use. You acknowledge and agree that BAM is under no obligation to credit, compensate, notify, or request further approval for the use of your submitted materials—regardless of the format, channel, or frequency of usage.

All video content must be original, relevant to the product, and submitted in a commonly accepted format (e.g., MP4, MOV). Likewise, all images and written feedback must be created by you, and you confirm that you own full rights to the content at the time of submission.

By participating in the Program, you explicitly agree to these terms and understand that you permanently relinquish any ownership, licensing control, or future rights to the media or feedback you submit.

All deliverables must be submitted within 14 to 21 days of receiving the product. Failure to meet this deadline may result in disqualification from the Program and/or request for product return.
